Type of property: the type of property is always indicated at each unit. Remark for independent villas: it is possible that a studio or dependence is attached the villa in order to accommodate maintenance personnel or the landlord himself. However complete privacy is always guaranteed. Please also see our general conditions concerning the maintenance of garden & swimming pool.
Quality: is a classification with a certain number of stars. This classification is assigned by one of our staff members and based on several criteria: location, sea view, interior, etc. It is thus a result of personal, general critiques from our co-operators.
Type of renting period: depending on the individual agreement with the owner, the type of renting period is determined. Only exceptionally could be deviated on these pre-stated renting periods.
Bedrooms: is the number of rooms serving only as bedroom; this could also be small sized children’s bedrooms (‘cameretta’) and open sleeping lofts.
Bathrooms: is the number of baths/showers plus lavatories (one lavatory is calculated as a half bathroom – 0,5)
Distance beach: is the shortest distance to arrive to the beach. This could also be small paths. It could happen that such a path is obstructed. magica Sardegna holidays can not be held responsible for it.
Distance shopping/restaurant & other: it is possible that in winter & low season these distances are longer than indicated in the description.
Sea view: it is possible that growing vegetation obstruct sea view from the property
Air conditioning: if ‘air-conditioning’ is mentioned, it means that at least one room disposes of an air-conditioning installation.
Services on the spot: in order to spend your holidays completely free of stress or worries what so ever, we offer a ‘service package’ for some holiday units. At the moment this ‘service package’ only apply to some units in the south of Sardinia. If a service package is wanted, it has to be specified at reservation. You can order these services by downloading: service package and send it by fax completely filled out and signed.

Water pipes and tap water: Water is very precious in Sardinia; sometimes it doesn’t rain in months. Don’t use it unnecessarily. It could happen that water is temporally put on rations, a situation for which magica Sardegna holidays can not be held responsible. The seawater however is so crystal clear and heavenly that we invite you to enjoy it as much as possible.
We advise you to boil tap water before using it in the kitchen or to buy mineral bottled water. The water pressure may not be optimal in every house. The drain pipes have a much smaller diameter as those we know in northern Europe. That’s why we earnestly request our guests never to put sanitary towels or tamps into the toilets. It could cause serious damage and ruin several days of your holiday. Please note that even an excessive amount of paper could already obstruct the pipes.
Sand: For the same reason (drain pipes extremely narrow) and in order to avoid any risk of obstruction in the pipes in the house, most of the houses in Sardinia have outside showers. Please take off all sand from clothing and linen before putting it into the washing machine.
Beach: The beaches in Sardinia consist of large sandy beaches, small bays and rock formations. Provide yourself with an umbrella, specially during low- and mid seasons, because most beaches do not have the facility for renting this equipment. During holiday season, nearby or even at the beach divers and surfers will find all necessary equipment for rent to practise their favourite sport. On most of the beaches dogs are not allowed.
Roads: Sardinia has an extensive road system, generally in good condition. The road leading to your holiday villa could however be small field track, often steep and rarely tarred, sometimes with important hollows due to torrential rain. If you drive in a low extended car, please inform at our agency. All cars with normal construction will not experience any difficulty in arriving on the spot.
Fauna: The fauna in Sardinia is not only the wild boars, cows, wild horses, sheep, goats or deers, who adventure on the roads at several occasions. It is also mosquito’s, spiders, field mice, ants and beetles. If a house is surrounded by vegetation, it’s normal that they find the way inside. It is therefore important not to leave any leftovers outside in the garden or on the terraces. Another most important advice we can give you is to provide in an insect lotion in your luggage.
Electricity: In most houses you can consume up to 2 or 3 Kw/h.. Avoid using to much electrical features, that consume a lot of electricity, at the same time (washing machine, boiler, hair dryer, etc.) In some houses plugs and sockets may be different from the types used in Northern Europe.
Fireplace: most of the houses have a fireplace that functions well. If you would like to use the fireplace, please inform your key-holder on arrival. If you start a fire in the fireplace, please make certain that smoke exhaust is optimal.
Furniture: do not put furniture outside if it belongs inside the house. Garden equipment is generally provided for this purpose. Furniture may give the impression to be old sometimes; for the landlord however it has most of the time a lot of sentimental value. Therefore he expects you to show respect.
Television: A satellite-TV is programmed and programming should not be changed. Reprogramming is mostly done by a TV-engineer and you could be charged for these expenses at departure.
Pets: If your four-footed friend comes along with you in Sardinia, please make sure your do not leave any trace (hair or other) when you leave. You will also forbid him to take place on beds or woollen blankets or in armchairs or on coaches.
Kitchen and kitchen ware: At departure the kitchen, the kitchen tools, plates & cutlery have to be perfectly clean, even if a certain amount for ‘final cleaning’ has been paid. You will not find percolators in most of the houses. However there will always be an Italian expresso coffeepot. If necessary you could provide in a thermos with filter top-piece in your luggage.
Bedrooms: the beds have good mattresses, few beds have a slatted base. Please always put your linen (or the linen at your disposal) on top of the mattress cover. If, at departure, the mattress cover should be dirty, a compensation is due.
Garden: The garden is mostly well kept. However some landlords prefer to keep a ‘natural garden’. In other words: this is a garden where indigenous plants and trees grow luxuriantly.
Like it is the case with the kitchen & the kitchenware, the barbecue will also be clean at departure.
Constructions: Sardinia is developing strongly. As a result one builds wherever it is still permitted. If we are informed about a construction next to the rented unit, we will immediately mention this on our website. Some constructions are stopped during some years and can not cause any acoustic nuisance to our guests. If a neighbour should start building or renovating, it is obvious that we have no authority what so ever. Nor do we have anything to say if local municipalities get it into their head to start breaking up the road or to asphalt it. Note that most constructions are worked on during law and mid season.
Obvious: At your arrival, if the house should not dispose of the necessary equipment (for ex. not enough cups, plates, no cork-screw, …..) please tell your receptionist. Therefore we advise you to check carefully your holiday house at arrival, because he will be able to provide the missing items. In residences, please turn to the reception. In case of serious shortages or defaults please contact our office immediately.
Southern island: We do not intend to scare you with these basic information, but please be aware that you travel to a marvellous southern island with its own characteristic particularities. Besides, every landlord has his own lifestyle and this shows itself in furniture, garden, etc. What all Sardinians have in common is their endless love for their island and their consciousness of its beauty and value.

General Provisions of Rental Agency Contract
The following terms of business apply with regard to the procurement of private vacation homes in Sardinia by magica Sardegna holidays bvba. These terms of business exclusively govern the legal relationship between the person who has made the rental request and magica Sardegna holidays bvba, i.e. a procurement contract with regard to a single tourism service (vacation home rental). By contrast, the successfully mediated rental relationship between the person who has made the rental request (referred to below as the Tenant) and the Sardinian home owner (referred to below as the Landlord) is exclusively governed by the provisions of the rental contract.
- By signing the rental request, the Tenant simultaneously makes two binding offers:
- an offer to conclude a procurement contract in the sense of a contract to conduct a business transaction in accordance with. The contracting parties are the Tenant and magica Sardegna holidays bvba (referred to below as the Agent);
- an offer to conclude a rental contract for a vacation home. The subject of this contract is the short term rental of a private property in Sardinia. The contracting parties of this contract are the Tenant and the Sardinian Landlord designated in the rental request. The Agent has been authorized by the Landlord to conclude such a contract on his behalf.
- The rental request is effected when the completed and signed Rental Request Form (Reservation Form) has been received by the Agent. This Reservation Form is binding for the Tenant.
- The agency contract as well as the rental contract come into existence when the Agent has indicated that the offer has been accepted - either in person, by telephone or in writing. The Tenant expressly waives the necessity of registered delivery for this indication of acceptance.
- The Agent confirms the rental request by forwarding one copy of the rental contract. A rental contract which differs in content from the rental request is considered to be a refusal of the original rental contract offer combined with a new offer. This new offer must be accepted by the Tenant.
- The Agent is obligated to provide the Tenant with proper intermediary agent services as well as to fulfil the resulting obligation to take due care, to provide information and consulting services. However, the Agent is neither liable for the provision of the contractual obligations of the vacation home Landlord nor for service defects involving the third party services that he has procured.
- The contractual basis of the agency contract consist of the house descriptions in the catalogue (or on the internet homepage) and the home owners´ price list that is valid for the respective year.
- The Agent is not liable to the Tenant for consulting errors that are the result of false information about the rental property provided by the Landlord.
- For the Tenant there is no charge for the agency contract. The Agent receives compensation in the form of a commission from the Landlord. This commission is calculated in the public renting price.
- The Agent is empowered to undertake all legally significant acts needed for modification, formulation and termination of the rental agreement (including collection of the rental payment, administration of the security deposit, cancellation or termination, and increase or decrease of rental payment). The Agent is authorized to take legal action to enforce the claims resulting from legal acts and to appoint an attorney on behalf of the Landlord. This authorization also encompasses out-of-court negotiations of all kinds, conclusion of a settlement to avoid legal action and receipt of payments.
- The place of jurisdiction for legal action undertaken by the Tenant against the Agent is the place of business of the Agent. The place of jurisdiction for legal action undertaken by the Agent against the Tenant is the place of business of the Agent.
- The invalidity of any provision of the contract shall not affect any part of the remaining contract.

Contract Terms of Rental Contract
Important: A booking query is intended to help you plan your vacation and is not a guarantee for the availability of a particular vacation house. The confirming answer of the Agent is no guarantee for the availability of the rental unit. The availability of a rental unit can only be confirmed when the Agent receives a ‘Reservation Form’ (or ‘Rental Request Form’). We do not mark the vacation home as occupied until we have received a binding rental request and the confirmation of the landlord or our office in Sardinia. So it is possible that another vacationer may beat you to it.
In any case, magica Sardegna holidays confirms the availability of your ideal vacation home within 48 hours. Please note that the Reservation Form or Rental Request Form is binding for the Tenant.
The following contract terms are effective in particular with respect to the rental contract that is procured by the Agent between the party requesting the rental (referred to below as the Tenant) and the respective Sardinian vacation property owner (referred to below as the Landlord):
- The rental contract between the Tenant and the Landlord is effected when the Agent receives the rental request form, which has been filled out completely and signed, and the Landlord has indicated his acceptance.
- The Agent is authorized to conclude the rental contract on behalf of the Landlord.
- The Landlord is obligated to permit the temporary use of the vacation rental property specified in the rental request for the rental period specified in the rental request. The Tenant is obligated to remit payment of the rent.
- The contractual basis consists of the characteristics of the respective vacation rental property as described in the catalogue (or on the internet homepage) of the property owners and the price list that is effective at the time the contract is concluded and the contract terms of the rental contract. Supplements to the agreement that modify the purport of the services that are to be provided must be made in writing in order to be valid.
- Check-ins at the vacation rental property will be possible as of 16:00 p.m. (local time) on the agreed upon date that the rental period commences. Check-outs on the final day of the rental period are at 10:00 a.m. (local time) at the latest. In case of unexpected delay the Tenant has to contact immediately by telephone the Landlord or the Agent. In case the Landlord or his representative could not be reached or in case the delay was not reported nor to the Agent nor the Landlord can be held responsible for any inconvenience that may occur to the Tenant. The Landlord or his representative who is obliged to extra transfer due to a delay of the Tenant, can recover his extra expenses from the Tenant. Arrivals after 20:00 p.m. can always cause an extra indemnification.
- The Tenant and the individuals that he has designated as members of his party are obligated to treat the vacation rental property with due care. On the Tenants’ departure, the vacation rental property will be swept clean, particularly the kitchen facilities, dishes, plates, cutlery & kitchen tools must be left washed & tidy, even though an amount for final cleaning had to be paid. If that is not the case the key-holder can decide not to refund the entire amount of the security deposit.
- The exact hour of departure has to be agreed upon with the landlord or his representative at the arrival of the Tenant.
- Arrivals before 16.00 p.m. or departures after 10.00 a.m. will each be charged at the price of one full day. Moreover, such arrivals/departures are only possible after the Agents’ consent.
- The Agent or the Landlord or his representative handle collection of the rental payment and administration of the security deposit.
- The Agent and the Landlord have the right to subsequently rectify a rental payment that was calculated incorrectly.
- The Landlord/the Agent has the right to demand an advance payment in the amount of 30% to 50% of the total rent on conclusion of the rental contract. This advance rental payment is payable on the date on which a copy of the rental contract is forwarded to the Tenant and should occur on the Agents’ bank account within the following 8 days. The balance of the rent due is payable at the latest 42 days prior to commencement of the rental period and must be remitted to the bank account specified in the rental contract without any further special request on the part of the Agent.
- Prior to the commencement of the rental period, the Tenant is obligated to provide a security deposit by transfer on the bank account of the Agent or cash at arrival in the amount of as mentioned in the rental contract.
- The Landlord has the right to refuse the Tenant access to the vacation rental property in the event that the rent and/or the security deposit has not been paid or provided in due time and in full prior to commencement of the rental period.
- The landlord has the right to refuse the Tenant access to the vacation rental property in the event that he arrives in greater number of persons as mentioned on the voucher or in the event that the landlord puts on record that the a greater number of persons as mentioned on the voucher are staying in the rental property.
- Prior to the commencement of the rental period, under the contract the Tenant has the right to cancel the rental contract. The Agent must be notified of the cancellation of the rental contract by writing. The Landlord can demand compensation for arrangements that have been made and expenses that have been incurred. If the rental contract is cancelled up until the 120th day prior to the beginning of the rental period, a payment amounting to 30% of the rent is due; up until the 80th day 50% of the rent is due; up until the 60th day 80% of the rent is due; and less than 60 days prior to commencement of the rental period 100% of the rent is due. The date on which the Agent receives the notification of cancellation is the basis for determining the above periods and compensation amounts. Cancellation or termination of the rental contract after the beginning of the rental period is not possible with the consequence that, even if the Tenant does not make use of his right to utilize the vacation rental property, he is obligated to pay the rent in full.
- The claims in art.15 on the part of the Landlord become invalid if the Tenant provides an adequate replacement tenant in accordance with the legal stipulations.
- In the event that the fulfillment of the rental contract is substantially impeded, endangered or impaired as a result of an act of nature or force majeure, the Tenant as well as the Landlord can terminate the rental contract. The Landlord can demand compensation from the Tenant for services that he has already delivered and expenses that he has incurred.
- The Tenant is liable for any damages to the vacation rental property that he or one of the individuals in his party cause.
- The Tenant is obligated to report any defects in the rental property promptly and to have the Landlord or a representative of the Landlord make a record of these defects on location in person. It is not sufficient for the Tenant to report the defect to the Landlord or the Agent after he has vacated the rental unit.
- In the event that defects become apparent, the Tenant is obligated to minimize any resulting damages. If he fails to fulfill this obligation to prevent any possible resulting damages or to minimize them, all claims on the part of the Tenant against the Landlord are excluded.
- Only defects that already exist on the date of arrival are regarded as defects in the rental property. The Tenant is responsible for prompt notification of defects and for proving the existence of the purported defect.
- The Landlord is obligated to remedy the reported defect within a reasonable period of time, whereby corrective measures must be undertaken according to local standards.
- If the Tenant stores valuables in the rental property he does so at his own risk. The Landlord is not liable in the event of loss or theft.
- The Tenant has been informed that the technical and building safety regulations and the quality of the sanitary, sleeping and living area furnishings in Sardinia do not always correspond with the standards of the country where the Tenant lives. Circumstances of this type and other circumstances that are typical for the geographic location cannot constitute a defect in the vacation rental property.
- The Landlord is liable for the condition of the vacation rental property that was promised in the rental catalogue. However, the Landlord and the Agent have the right to change the information in the catalogue up until the time that the contract has been concluded. The Tenant must be informed of any such changes before the rental contract is accepted by the Landlord.
- The Landlord will make an effort to take requests to change the dates of the rental period into consideration, in so far as the realization of such a request is possible and reasonable.
- Outside maintenance: If necessary, the landlord or his representative have the right to enter the property (not the house) in order to carry out repairs or maintenances outside, such as swimming pool, garden, etc.
- House rules: On the rental request the names, first names and birthdays of all guests are mentioned. If more guests are arriving, or are staying in the vacation rental the Landlord can forbid entrée. Pets have to be mentioned at rental request. Regardless of the remarks in the catalogue, each rental request must mention pets and allowance will be admitted individually. Never will they be allowed in the swimming pools nor on beds or coaches. Tents in the garden are forbidden. It is clear that all linen and furniture, besides the garden-furniture, belongs in the house and not outside. If the Tenant does not respect these wishes of the Landlord, the rental contract can be terminated immediately without compensation for the Tenant.
- Liability: the Agent is liable for the good administration of the rental agreement, and so following to the acceptable wishes of the Tenant and following to here obligations mentioned in these conditions. The Agent or the Landlord is responsible for any physical injuries or damage that the Tenant should encounter, nor for theft or damages of items belonging to the Tenant. The Agent is not responsible for shortcomings in the realization of a contract due to facts caused by the Tenant or in case of unexpected circumstances for which third parties have to be blamed. In any case is the total liability of the Agent limited to the refund of the by the Tenant already paid rental amount.
- The invalidity of any provision of this contract shall not affect any part of the remaining contract.
